<p style="text-align:justify;">At the center of the dispute is Regulation 7.3.0(i) of the UGC Regulations, 2018, which requires a Vice-Chancellor to possess a minimum of ten years’ experience as a Professor in a university, or equivalent experience in a reputed research or academic administrative organization. </p>

<p style="text-align:justify;">These regulations, framed under Section 26 of the UGC Act, 1956, have statutory force and are binding on all universities across India.</p>
<p style="text-align:justify;">According to the notice, the Ministry’s advertisement dated 21 May 2022 for the MGCU Vice-Chancellor post explicitly adopted these UGC norms. </p>
<p style="text-align:justify;">However, information obtained under the Right to Information Act from Banaras Hindu University (BHU) indicates that Prof. Srivastava was promoted to the rank of Professor (Stage-5) only on 4 October 2012 after approval by BHU’s Executive Council. </p>

<p style="text-align:justify;">Based on this date, the petitioner argues that by the June 2022 cut-off, Prof. Srivastava had completed only nine years and eight months of service as a Professor, falling short of the mandatory ten-year requirement.<br />The notice draws strength from judicial precedents as well .</p>
<p style="text-align:justify;"> In a 2022 ruling, the Supreme Court of India clarified that experience in non-teaching bodies cannot be equated with experience “as Professor” under UGC Regulation 7.3.0.</p>
<p style="text-align:justify;"> Similarly, the Himachal Pradesh High Court in Dr. Dharam Pal Singh v. State of H.P. (2021), relying on Union of India v. M. Bhaskar (1996), held that notional or retrospective promotions cannot be counted for eligibility; only actual service from the date of promotion is valid.</p>

<p style="text-align:justify;"> It also flags alleged inconsistencies in Prof. Srivastava’s curriculum vitae regarding his Fulbright association with American University, Washington D.C., suggesting possible misrepresentation. He was there as visiting scholar instead of visiting professor, Pahal claimed.</p>

<p class="MsoNormal" style="text-align:justify;"><span lang="hi" xml:lang="hi">छात्र ने बताया कि सभी फॉर्मैलटीज़ को पूरा करने के बाद छह फरवरी को विश्वविधालय के ऑफिसर ऑन ड्यूटी (ओएसडी) सच्चिदानंद सिंह ने एक आदेश पत्र मेरे नाम से निकाला कि गलती से नामांकन हेतु अंतिम तिथि 31 जनवरी 2025 की तिथि के बाद मेरे नामांकन को आदेशित कर दिया गया है, एक ‘प्रोसीडुरल लैप्स’ है | इसलिए छात्र के नामांकन को तत्काल अगले आदेश तक स्थगित किया जाता है और आपको इस बीच रिसर्च स्कालर के रूप मे यूनिवर्सिटी से मिलने वाले किसी भी तरह के लाभ से बँचित किया जाता है |</span></p>

<p class="MsoNormal" style="text-align:justify;"><span lang="hi" xml:lang="hi">बताया गया कि विभाग मे किसी भी डीन का नहीं रहने के कारण रिजल्ट को जारी करने की जिम्मेवारी खुद कुलपति संजय श्रीवास्तव की है | और अंततः 4 फरवरी को बिभाग के वेबसाइट पर रिजल्ट जारी कर दिया गया, जिसमे छात्र धनंजय मिश्रा का नाम भी था | छात्र ने बताया कि जब रिजल्ट ही 4 फरवरी को आया तो मै 31 जनवरी के पहले तक अपना नामांकन कैसे करवाता | मामले मे 15 दिन से अधिक हो गए अब तक मेरे नामांकन को होल्ड रखा गया है |</span></p>

<p class="MsoNormal" style="text-align:justify;">MOTIHARI : A district court of Bihar’s Motihari has issued an arrest warrant against the former vice chancellor of Mahatma Gandhi Central University (MGCU) at Motihari Arvind Agrawal.</p>
<p class="MsoNormal" style="text-align:justify;">Court took cognizance under section 420, 465,467,471 and 504 of Indian penal code while hearing a complaint filed by Motihari based social activists Raju Baitha.</p>

<p class="MsoNormal" style="text-align:justify;">Additional chief judicial magistrate (ACJM) 5 in Motihari court has issued the arrest warrant after taking cognizance in the case. Court while observing in the order sheet told that there is sufficient ground found in the complaint .   </p>
<p class="MsoNormal" style="text-align:justify;"> The documents made available before court was sufficient to prove the allegations made against him and three professors of the same university Dr Shashikant Ray, Dr Pramod Kumar Mina and Bhanu  Pratap Singh also supported the allegations while appearing before the court.</p>
<p class="MsoNormal" style="text-align:justify;">Mr Agrawal was alleged to have fraudently procured the post of vice chancellor in MGCU after misleading the selection committee. In his application filed before MHRD, Delhi for the post of vice chancellor, he wrongly mentioned his degree of Ph.D. He did Ph.D from Rajasthan University but misled the selection committee citing his Ph.D done from Heidelberg at Germany.</p>
<p class="MsoNormal" style="text-align:justify;">Besides, he mentioned certificates marks of his graduation as 60 % instead of 44 % he actually procured.</p>
<p class="MsoNormal" style="text-align:justify;">The evidence of such fraud was collected through RTI informations procured from Rajsthan and Germany University.   </p>
<p class="MsoNormal" style="text-align:justify;">After issues were raised in the media, Agrawal resigned from the post and left the university overnight, dodging his supporters. Former President Ram Nath Kovind had accepted the resignation of Arvind Agarwal who has been under the government's radar for allegedly giving false information while applying for the post.</p>
<p class="MsoNormal" style="text-align:justify;">As he fudged his academic credentials to get the post, the HRD Ministry had forwarded his resignation to Kovind, who is then Visitor to the university.</p>

<p class="MsoNormal" style="text-align:justify;">The ministry received complaints that Agarwal lied about a foreign education to get the job. He did not pursue his Ph.D at a German institute as claimed, and actually got the degree from the University of Rajasthan, it was a complaint.</p>

<p class="MsoNormal" style="text-align:justify;"><span style="font-size:14pt;line-height:115%;">MOTIHARI : Chief minister of Bihar Nitish Kumar while inspecting and inaugurating  numbers of projects hailed the district administration’s efforts in implementing the various governments schemes on Wednesday.</span></p>
<p class="MsoNormal" style="text-align:justify;"><span style="font-size:14pt;line-height:115%;">He however, refused to comment on inordinate delays in the land acquisition works of Mahatma Gandhi Central University (MGCU) exasperating journalists raining questions on the issues just after he came out Radha Krishnan Bhawan after addressing a review meeting on govt schemes.</span></p>
<p class="MsoNormal" style="text-align:justify;"><span style="font-size:14pt;line-height:115%;color:#222222;">Nitish Kumar in its 27 days of ‘Samadhan Yatra’ <span> </span>reviewed the on going projects and social welfare schemes, inspected schemes under his <span> </span>‘seven resolve’ and also inaugurated new constructed OPD building of Motihari Sadar Hospital, district panchayat resource center and bio- gas plant.</span></p>

<p class="MsoNormal" style="background:#FFFFFF;text-align:justify;"><span style="font-size:14pt;color:#222222;">CM after completing his itenery at Gopalgunj landed in Motihari in after noon and left for Siswa Purvi Panchayat under Banjariya block also inspected the sites of various ongoing schemes in the nearby villages with District Magistrate Shirshat Kapil Ashok and superintendent of police (SP) Kantesh Kumar Mishra.</span></p>
<p class="MsoNormal" style="background:#FFFFFF;text-align:justify;"><span style="font-size:14pt;color:#222222;">He also initiated the 170 solar lamps fitted on roads of the panchayat . He also inspected a pond which was constructed recently and expressed his happiness over works. </span></p>

He took stock of the grievances of local village folk and issued directions to the DM.</span></p>

<p class="MsoNormal" style="text-align:justify;"><span lang="hi" xml:lang="hi">मोतिहारी में 15 फ़रवरी को समाधान यात्रा के माध्यम से वे गाँव के अलग -अलग जगहों पर घूमेंगे और लोगों से मिलेंगे और कुछ ख़ास विकास से जुड़े योजनाओं का अवलोकन भी करेंगें ताकि उसकी परेशानियों का त्वरित समाधान करके कार्यों में तेज़ी लायी जा सके |  </span></p>
<p class="MsoNormal" style="text-align:justify;"><span lang="hi" xml:lang="hi">समाधान यात्रा से पूर्व उन्होंने दिसम्बर 2021 में ‘समाज सुधार अभियान यात्रा’ शुरू किया था, जिसमे लोगों को जागृत करते हुये नशा बंदी, दहेज़ प्रथा, बाल विवाह जैसे मामले उछाले गये थे |</span></p>
<p class="MsoNormal" style="text-align:justify;"><span lang="hi" xml:lang="hi">सनद रहे कि मुख्यमंत्री के सभी यात्राओं की शुरुआत चंपारण से ही होती है और अपने चंपारण प्रवास के दरम्यान मुख्यमंत्री समय- समय पर विकास योजनाओं की  घोषणा भी करते रहे है | पूर्वी चंपारण जिले में पूर्व के यात्राओं में उन्होंने कल्याणपुर प्रखंड क्षेत्र के माधोपुर स्थित ‘मोर गाँव’ और मेहसी के शिप उद्योग के विकास का भी आश्वासन दिया था | मेहसी का शिप उद्योग तो बंदी के कगार पर पहुँच ही गया माधोपुर में बहुतायत की संख्या में पाए जाने वाले मोर पक्षी अब कहीं देखने को भी नहीं मिलते |</span></p>
<p class="MsoNormal" style="text-align:justify;"><span lang="hi" xml:lang="hi">सरोतर झील और केसरिया का बौद्ध स्तूप के विकास का आश्वासन दिया गया था, परन्तु ये सभी घोषनाये अब तक फाइलों में ही कैद है | नीतीश कुमार के प्रयास से मोतिहारी को एक केन्द्रीय विश्वविद्यालय तो मिला लेकिन आज तक उसकी जमीन नहीं मिल सकी |</span></p>
<p class="MsoNormal" style="text-align:justify;"><span lang="hi" xml:lang="hi">केन्द्रीय विश्व विद्यालय को लेकर 302 एकड़ भूमि प्रस्तावित थे, परन्तु अपने स्थापना के सात साल बीत जाने के बाद भी जिला प्रशासन महज़ 136 एकड़ भूमि ही विश्वविद्यालय प्रबंधन को उपलब्ध करवा सकी | 165 एकड़ भूमि जो अभी तक विश्विद्यालय प्रशासन को नहीं मील सकी उसमे स्वामित्व को लेकर विवाद तो है ही साथ ही मिले हुये 136 एकड़ भूमि में भी स्वामित्व को लेकर गंभीर विवाद है | ऐसे में प्रशासन अब विवादित जमीनों को छोड़ कही अन्यत्र भूमि लेने पर भी विचार कर रही है |</span></p>

<p class="MsoNormal" style="text-align:justify;"><span lang="hi" xml:lang="hi">किसान बिभूति सिंह ने कहा कि 102 एकड़ जमीन का पेमेंट रैयतों को नहीं मिला लेकिन जमीन विश्वविद्यालय को दे दी गयी और विश्वविद्यालय के नाम जमा बंदी भी कायम हो गयी | टाइटल को लेकर तत्कालीन जिलाधिकारी ने हम लोगों के फाइल को ‘लारा’ नामक एक कमिटी को भेज तो दिया लेकिन वहां आज तक कोई अधिकारी इस मामले को देख भी नहीं सके ऐसे में कैसे माना जाए प्रशासन विश्वविद्यालय की जमीन को लेकर संजीदा है |</span></p>

<p class="MsoNormal" style="text-align:justify;">MOTIHARI: Conceived just a year prior to Champaran Satyagrah centenary celebration, Mahatma Gandhi central university (MGCU) at Motihari is likely to be relocated from Motihari to Bettiah in west Chamaparan district in Bihar.</p>

<p class="MsoNormal" style="text-align:justify;">The Ministry of Human Resource departments (MHRD) at Delhi has recently hinted to the district administration to look out a potential site with approximately 302 acres- required chunk of land for this project. District Magistrate of East champaran Shirshat Kapil Ashok has revealed this in a recently held meeting in Motihari.</p>
<p class="MsoNormal" style="text-align:justify;"> “Land earmarked for MGCU has been landed in a legal battle. Revenue officials are yet to decide the title of the land”, said an official in the land acquisition department in the district.   </p>
<p class="MsoNormal" style="text-align:justify;">As the state government failed to provide required land to MGCU even after seven years of its inception, the university is still being run in the scattered locations in the rented buildings across the city. This is the reason why the Central government has not sanctioned even a penny for the development of this much needed campus.</p>
<p class="MsoNormal" style="text-align:justify;">Out of 302 acres to be transferred to MGCU, 136 acres of land has been handed over to university administration and the ownership dispute of 102 acres of land out of 136 acres is still undecided. The farmers, who claimed to be the owner of these lands alleged that district administration had acquired their land and also mutation, were created in the name of MGCU but they are yet to be paid.</p>
<p class="MsoNormal" style="text-align:justify;">“Why don’t we blame the authorities who are acting as squatters in this matter? Our lands have been taken away without compensation. They are neither deciding the matter of title nor paying us up”, alleged aggrieved farmer cum social activist Bibhuti Narayan Singh.</p>
<p class="MsoNormal" style="text-align:justify;"> “Can Chief Minister Nitish Kumar solve this standoff between farmer and land acquisition department? If not he should stop his “Samadhan Yatra” ( solution itinerary), said Singh adding that he should send a team from the  officials engaged in land record survey in motihari.</p>
<p class="MsoNormal" style="text-align:justify;">Ray Sunderdeo Sharma founder of Champaran Vikas Morcha-representative outfit of locals came down heavily on the state government for compelling the Center to relocate the MGCU site. “Neither district administration nor RARA- land acquisition, rehabilitation and resettlement authority could resolve these issues.”, he said adding RERA authority could not take up the issues yet.  </p>
<p class="MsoNormal" style="text-align:justify;">Acting vice chancellor Dr Anand Prakash told BNM that the proposal of remaining 165 acres of land pending before the education department of the state government is awaiting its final go ahead. Once that land is transferred to us, we will start our development works on campuses.   </p>

<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">The programme began with the introductory note of Prof. Asheesh Srivastava, Head and Dean, Department of Educational Studies MGCU  where he shared his thoughts and views on the life of George Orwell. He mentioned that it is a matter of Pride for all of us that Such a Classic writer was born in Motihari Champaran and this is our moral responsibility to make our upcoming generation and students aware about the writings and life of George Orwell.</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">He mentioned that Orwell was his pen name by which he is famously known, his original name is Eric Aurther Blair. Further Prof. mentioned that he has been working in this field and has been constantly in touch with his son Richard Blair, Prof. Jean Stone (Director, Orwell Foundation University College of London, Britain), Jeremy weekly (Program Manager Orwell Foundation) Quintin Koff (Director, Orwell Society).</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">Vice Chancellor, MGCU, Prof Sanjeev Kumar Sharma, shared his insights on the life of George Orwell and how much he is celebrated even now because of his classic masterpieces like Animal Farm and 1984..</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">Pro- VC MGCU, Prof. G. Gopal Reddy also shared his experiences and insights on the life and literary works of Orwell. Also he emphasized on how much the day 25th June  is important in the Indian history</span><span style="font-size:14pt;">. </span><span style="font-size:14pt;">for your gracious presence which made this event a successful one.</span></p>

<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">Further the discussion session was followed by the presentation “Remembering George Orwell” by  Astik Mishra, M.Phil. Research Scholar, DoES, SoE, MGCU under the guidance of Prof Asheesh Srivastava, Head and Dean, Department of Educational Studies, School of Education, Mahatma Gandhi Central University, where he wonderfully described about the life and literary works of George Orwell.</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">The programme was then followed by formal Vote of thanks delivered by Dr. Pathloth Omkar, Assistant Professor, Department of Educational Studies, School of Education, Mahatma Gandhi Central University. </span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">Programme was hosted and managed by Suprabha Dey, Ph.D Research Scholar, Department of Educational Studies, School of Education, Mahatma Gandhi Central University.</span></p>

<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">Extension order issued by Modi Government has landed government education secretary and education minister in limelight for their differences over the opinions on tenure extension of VC Sharma- BNM has accessed the documents.</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">BNM has learnt that education minister while issuing extension order deliberately ignored the suggestions of President of India and The Chancellor Mahesh Sharma both. Chancellor had written many letters to President Ramnath Kovind and apprised issues with VC asking president’s interventions in the matter as visitor of Central universities.</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">In terns, President Ramnath Kovind directed Ministry for education to inquire in to the allegations cited in Chancellor’s letters.</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">Including Presidents directions and all the letters of Chancellor Mahesh Sharma, the letters of Bihar’s parliamentarians were hushed up to benefit Prof Sanjeev Sharma-own brother of Kumar Viswas- noted poet and erstwhile AAM Adami party leader.</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">President of India secretary KD Tripathy also directed Amit Khare, secretary education (higher education) to take necessary action against Sanjeev Sharma. Amit Khare was not in favour of any extension of tenure of Sanjeev Sharma as VC. He had directed VC Shama to relinquish the post and give charge to any eligible persons until new VC is appointed- BNM reads.  </span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">The term of Sanjeev Sharma, Vice-Chancellor of the Mahatma Gandhi Central University (MGCU) in Motihari, Bihar, was supposed to end on 2 February .</span></p>
<p><span style="font-size:14pt;">Allegedly Padmakar Mishra, OSD of MGCU wrote a letter to Ministry regarding extension of Sharma tenure as VC but suppressed the central university rule 2009 rule 44 which says that the terms of first VC could not be more than five years. Ministry also suppressed the fact that VC Sharma has been grilled many times on the allegation levelled against him. Kiram Ghai- member of executive council of MGCU also questioned state of affairs of VC Sharma.  </span><br />
<span style="font-size:14pt;">Sharma is facing complaints of sexual harassment and allegations that he fudged documents to gain a promotion during his time at the Chaudhary Charan Singh University (CCSU) in Meerut.</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">If documents procured under Right to Information Act is to believed, Amit Khare signed on Sharma relinquishing the office, while education Minister extended the terms ignoring all the serious charges against him.</span></p>
<p><span style="font-size:14pt;">Documents also show that charges against VC are under examination until January, when the extension was approved. President of India-the visitor of Central universities did not approve the extension order until recently.</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">The secretary signed on the note sheet on 28 January saying Sharma may be relinquished. On the same day, however, Pokhriyal signed on the option that “the present Vice-Chancellor of Mahatma Gandhi Central University, Prof. Sanjeev Kumar Sharma, may continue in office notwithstanding the expiry of the tenure till his successor is appointed.”</span></p>
<p style="font-weight:400;text-align:justify;"><span style="font-size:14pt;">Authorities from MGCU refused to comment on the development while VC Sharma responding to a query under RTI filed by one Sandeep Pahal denied all the charges against him as false and fabricated citing it is  to tarnish his image by a group of vested interests.</span></p>
