MOTIHARI: Patna High court on Wednesday took cognizance in a criminal writ filed by one Kishor Chandra Mishra and others accusing 18 persons including then Superintendent of Police (SP) of Motihari Navin Chandra Jha, town inspector Vijay Ray and Sub-inspector Jitendra Kumar Singh.  

The development is supposed to be a shock banker to Navin Chandra Jha now deputy inspector general (DIG) of Shahabad range in Bihar and over two dozen realtors active in Motihari.  

The land sharks alleged to be eying a piece of land worth over 50 crores located in between railway station to town police station and attempt to grab this land with alleged police-realtors nexus led this criminal writ.  

Justice Dr Ansuman, while hearing an “FIR quashing’ issued notices to named private persons and directed ‘no coercive’ in case bearing 422/2021 under town police station against all petitioners. For Navin Chandra Jha and other cops, the advocate general of government has already put up their reply. 

Advocate Shailendra Kumar Verma-also one of the petitioners in the writ, alleged that over hundreds land mafias tried to grab their highly valuables properties in connivance of then SP, town inspector and a sub-inspector on June 24, 2021. 

 Failing which, they alleged police not only implicated all the petitioners in a false and fabricated case of SC ST atrocities case, but made it true and, the petitioners case filed against realtors were declared false only to benefit land sharks involved in the crime, they alleged.

What is most shocking and surprising is that the High court had already restrained the land in question from changing its nature in a second appeal filed by petitioners. Despite knowing all these legal facts, then police establishments alleged to have allowed these grabbers to erect boundaries over the lands at the gun points. The grabbers were the third party in the ongoing civil dispute on the land in question. 

 The boundary walls, however, were finally reduced to rubbles by an enraged mob after then Bihar DGP intervened in the incident and neutralized locals' cops alleged to be hand in gloves with realtors. 

Besides, a journalist belonging to ‘Border News Mirror’ who dared to carry out all these stories was also implicated in another false cases bearing no 432/21 (Town PS) only to compel him not to raise the voice of victims. BNM carries stories in its print editions on 25 and 28 June and its editor was implicated in a case on 30 June, 2021. There is a long civil dispute pending in court between Scribe’ family and complainant- used by vested interests in filing this FIR.  Press council of India (PCI) had already taken cognizance against Navin Chandra Jha, Vijay Ray and Jitendra Singh after journalists complained and PCI also issued notices against them. 

Top court' cognizance stirred up realtors having political patronage as well in the district and men in uniform, who alleged to have misused their post and powers during the span of their postings in Motihari. After Kantesh Kumar Mishra-SP joined Motihari, the dreaded land mafias were neutralized, and they remained in hibernation waiting for their comfortable and favorable ambience . 

A senior advocate in Patna high court, who was earlier assigned in the writ by petitioners was alleged to have been influenced by accused persons and have not been  appearing before court despite repeated calls by the court on date. Sensing faul play, another advocate was  engaged in the case and his excellent arguments in court led to this development. Alleged 'influenced advocate' withdrwn many writs filed against Navin Chandra Jha and others without having consents of applicants. They are preparing to file again their writ  through new advocate assigned in above said writ, they added.
