Doctors and Police to equally share the blame of the slow pace of speedy trail if any- PP Digvijay

MOTIHARI : Public prosecutors are supposed to be “Gate Keeper” of criminal justice and they plays pivotal roles in  adjudication in the court. In criminal cases, prosecutors are responsible for representing not only the interests of society at large, but also those of victims of crimes. They also have duties to other individuals, including persons suspected of a crime and witnesses.

When the society at large is engulfed in criminal activities due to many social-economic reasons, the role of public prosecutors has become crucial. The culprits and offenders are needed to be brought to justice while the innocent’s acquittal is necessary for their reposition of faith in laws.

If Digvijay Narayan Sinha, public prosecutor posted in Motihari court is to be believed, the police and doctors brace up the prosecution works and primarily bolster prosecution adjucation during judicial process. “ But at times, prosecution became helpless due to negligence of ‘investigating officer’ and doctors, who happens to be crucial witness in crime for the injuries.

Police, who assist prosecution ensuring witnesses on court and their timely availability of  police diaries in court and evidences therein, force hardcore criminals to remain behind bar until trial is completed.

Courts’ orders to make available diary are often turned deaf ears causing enlargement of culprits persons at times. Sometimes court has to reject the bail without mentioning diary content. Such orders are often cause delay in bail in higher court that is against the rule of law basic instinct of judicial procedure, he said.

He said we have occasional sittings with district magistrate and superintendent of police and all time we request for timely diary and availability of other witnesses but to no avail.

Motihari SP Dr kumar Ashish has also called meeting of cops few weeks ago to redress the grievances of prosecutions. Still the situation is same. Many undergoing speedy trails got affected due to non-availabilities of witnesses. Investigating officers and doctors too takes a numbers of dates to appears before court . “Sometimes their absence helps out hardcore criminals and history sheeter to get exoneration” additional public prosecutor Sadhu Sharan Singh said adding that out of fear of criminals, some witness either abstain the court or turned hostiles.

District magistrate east champaran Shirshat Kapil Ashok had once reprimanded prosecution officers for unwanted delay of speedy trials and in rejoinder of shaw cause on slow pace they said “police and doctors should equally share the blame”
